Y.X Community (the “Community”) is proprietary owned, run and operated solely by YdotX Services Limited, a company incorporated with limited liability under the laws of Hong Kong.

The Community respects your legal rights of privacy viewing or using this website and any pages herein (collectively, this “Website”). This Personal Data Collection Statement and Privacy Policy have been developed in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) (the “Ordinance”) of the Laws of the Hong Kong Special Administrative Region of the People’s Republic of China. The Community is committed to protecting the privacy, confidentiality and security of the personal information it holds by complying with the requirements of the Ordinance with respect to the management of personal information. The Community is equally committed to ensuring that all of its employees and agents uphold these obligations.

If you are under the age of 18, you must have a legal representative such as a parent or guardian accepting this Personal Data Collection Statement and Privacy Policy on your behalf before providing any personal information and/or data to the Community.

1. Purpose of Collection of Personal Data
   1. In the course of using this Website, you may be requested to disclose or provide your personal information and/or data to have the benefit of and enjoy various services offered by this Website.
   2. Although you are generally not obliged to provide the information and/or data as requested on this Website, the Community will not be able to render certain services on this Website in the event that such personal information and/or data is not provided.
   3. If you wish to apply for membership in the Community, you are required to supply your personal information and/or data as requested in the membership application, failing which may result in the Community being unable to process the application. If the application is successful, further personal data and information may be collected during the period when your membership continues for such purposes as listed below.
   4. The Community’s purposes for collection of information and data on this Website include but are not limited to the following:
      • to provide you with marketing and promotional materials for your enjoyment of benefits as members of this Website (for further details, please refer to section D headed “Subscription of Newsletter/Promotional Materials/Marketing Materials” below);
      • to provide you with a platform and forum for posting content, sharing and discussing insights in respect of services or products related to learning;
      • to allow members of this Website to enjoy their benefits as members by enrolling in special events hosted by the Community and/or its affiliates;
      • to design, provide and improve products, facilities and services to you in relation to the above purposes;
      • to compile, analyze and aggregate statistics about your use of this Website and services provided by the Community for the Community’s internal use;
      • to facilitate the Community and/or its affiliates to use your personal data for purposes relating to services, special events and/or promotions of the Community, its affiliates and/or their respective clients;
      • to process your application for membership in the Community;
      • to meet any disclosure requirements under any applicable law;
      • to verify information supplied by you to the Community; and
      • any other purpose which you may agree from time to time.
   5. The Community strives to only collect personal data which is necessary and adequate but not excessive in relation to the purposes set out hereinabove. If the Community requires the use of your personal data for purposes other than those set out hereinabove, the Community will request for your prescribed consent to the same.
2. Collection of Personal Data
   6. The Community may collect your personal information and/or data such as your name, log-in ID and password, address, email address, phone number, age, gender, date of birth, country of residence, nationality, education level, social media account ID, and work experience that is/are not otherwise publicly available. Occasionally, the Community may also collect additional personal information and/or data from you in connection with contests, surveys, or special offers. Only duly authorized staff of the Community will be permitted to access your personal information and/or data, and the Community shall not release such personal information and/or data to any third party save and except for the circumstances listed out under Section C headed “Disclosure or Transfer of Data”.
3. Disclosure or Transfer of Data
   7. The Community agrees to take all practicable steps to keep all your personal information and/or data confidential and/or undisclosed, subject to circumstances listed hereinbelow. Generally speaking, the Community will only disclose and/or transfer your personal information and/or data to the Community’s personnel and staff for the purpose of providing services to you. However, the Community may disclose and/or transfer such information and/or data to third parties under the following circumstances:-
      • Where the information and/or data is disclosed and/or transferred to any third party supplier or external service provider who has been duly authorized by the Community to use such information and/or data and who will facilitate the services/operation of this Website, under a duty of confidentiality;
      • Where the information and/or data is disclosed and/or transferred to any agents, affiliates or associates of the Community who have been duly authorized by the Community to use such information and/or data;
      • Where the Community needs to protect and defend its rights and property;
      • Where the Community considers necessary to do so in order to comply with the applicable laws and regulations, including but not limited to compliance with a judicial proceeding, court order, or legal process; and
      • Where the Community deems necessary to maintain and improve the services provided by this Website.
   8. Personal data collected through this Website may be transferred, stored and processed in any country in which the Community or its affiliates operate. By ticking the box on the signup page of this Website to indicate your agreement to this privacy policy, you accept that you have consented to and authorized the Community to disclose and/or transfer your personal information and/or data under the circumstances stated above, as well as to any transfer of information outside of Hong Kong.
4. Subscription of Newsletter/Promotional Materials/Marketing Materials
   9. The Community and its affiliates may from time to time send to you newsletters, promotional materials and marketing materials based on the personal information and data that you have provided.
   10. The Community may use your personal information and/or data in direct marketing in accordance with the Ordinance, in which case the Community requires your consent or indication of no objection.
   11. In this connection, please note that the following classes of services, products and subjects may be marketed:
       • Products and services relating to Blossom Fortune Limited;
       • Special events hosted by the Community and its affiliates for members of the Community, including but not limited to courses, workshops, and competitions;
       • Reward, loyalty or privilege programs and related products and services
       • Special offers, including coupons, discounts, group purchase offers and promotional campaigns;
       • Products and services offered by the Community’s affiliates and advertisers (the names of such affiliates and advertisers can be found in the relevant advertisements and/or promotional or marketing materials for the relevant products and services, as the case may be); and
       • Donations and contributions for charitable and/or non-profit making purposes.
   12. The above products, services and subjects may be provided or (in the case of donations and contributions) solicited by the Community and/or:
       • The Community’s affiliates;
       • Third party service providers providing the products, services and subjects listed in paragraph 11 above; and
       • Charitable or non-profit marking organizations.
   13. In addition to marketing the above services, products and subject itself, the Community also intends to provide the data described in paragraph 6 above to all or any of the persons described in paragraph 7 above for use by them in marketing those services, products and subjects, and the Community requires your written consent or indication of no objection for that purpose.
   14. The Community may receive money or other property in return for providing the data to the other persons in paragraph 7 above and will inform you of the same when requesting for your written consent as described in paragraph 10 above.
   15. Suitable measures are implemented to make available to such members the options to “opt-out” of receiving such materials. In this regard, you may indicate your objection to receiving such materials by not ticking the relevant box on the sign up page, or contacting the Community Engagement Team by sending email to community@ydotx.com.
5. Access and Amendment of Personal Data
   16. You are entitled to request access to or make amendments to your own personal information and/or data kept with the Community in accordance with the provisions of the Ordinance. Any data access request or data correction request may be made to our Community Engagement Team by sending e-mail to community@ydotx.com. Alternatively, you may amend your personal information and/or data by logging into your account.
   17. In the event that you wish to amend your personal information and/or data, the Community may request you to provide certain personal details in order to verify and confirm the accuracy of such personal information/data. HKID card number or passport number or business registration certificate number cannot be amended unless such data is proved to be inaccurate. Upon being satisfied that the personal data to which a data correction request relates is accurate, the Community shall comply with the data correction request in accordance with the Ordinance.
6. Access and Amendment of Personal Data
   18. The Community does not collect any personally identifiable information from you whilst you visit and browse this Website, save and except where such information is expressly requested. When you access this Website, the Community records your visits only and does not collect your personal information and/or data. This Website’s server software will also record the domain name server address and track the pages that you visit and store such information in “cookies” and gather and store information such as internet protocol (IP) addresses, browser type, referring/exit pages, operating system, date/time stamp, and clickstream data in log files.
   19. The Community does not link the information and data automatically collected in the above manner to any personally identifiable information. The Community generally uses such automatically collected information and data to estimate the audience size of this Website, gauge the popularity of various parts of this Website, track your movements and number of entries in the Community’s promotional activities and special events, measure your traffic patterns and administer this Website. Such automatically collected information and data will not be disclosed save and except in accordance with the Section C headed “Disclosure or Transfer of Data”.
7. Links to Other Websites / Media Platforms / Applications
   20. This Website may provide links to other websites / media platforms / applications which are not owned or controlled by the Community. Your personal information and/or data may be collected on these other websites / media platforms / applications when you visit such websites / media platforms / applications and make use of the services provided therein. Where and when you decide to click on any advertisement or hyperlink on this Website which grants you access to another website / media platform / application, the protection of your personal information and/or data which are deemed to be private and confidential may be exposed in these other websites / media platforms / applications.
   21. If you gain access to this Website via your account registered with online social networking tools (including but not limited to Facebook and Instagram), you are deemed to have consented to the terms of this Personal Data Collection Statement and Privacy Policy, and your personal information and/or data which have provided to those networking tools may be obtained by the Community and be used by the Community and its authorized persons in and outside of Hong Kong for the purpose of providing services and marketing materials to you. You are deemed to have consented to the Community and its authorized personnel’s access and use of their personal data so obtained, subject to the other provisions of this Personal Data Collection Statement and Privacy Policy.
   22. This Personal Data Collection Statement and Privacy Policy is only applicable to this Website. You are reminded that this Personal Data Collection Statement and Privacy Policy grants no protection to your personal information and/or data that may be exposed on websites / media platforms / applications other than this Website, and the Community is not responsible for the privacy practices of such other websites / media platforms / applications.    23. The security of your personal information and/or data is important to the Community. The Community will always strive to ensure that your personal information and/or data will be protected against unauthorized access. The Community has implemented appropriate electronic and managerial measures in order to safeguard, protect and secure your personal information and/or data.

All your personal information and/or data are only accessible by the authorized personnel of the Community or its authorized third parties, and such personnel shall be instructed to observe the terms of this Personal Data Collection Statement and Privacy Policy when accessing such personal information and data. You may rest assured that your personal information and/or data will only be kept for as long as is necessary to fulfill the purposes for which it is collected.

   26. The Community uses third party payment gateway service providers to facilitate electronic transactions on this Website. The Community reserves the right to update, revise, modify or amend this Personal Data Collection Statement and Privacy Policy at any time as the Community deems necessary and you are strongly recommended to review this Personal Data Collection Statement and Privacy Policy frequently. If the Community decides to update, revise, modify or amend this Personal Data Collection Statement and Privacy Policy, the Community will post those changes on this Website and/or other places the Community deems appropriate so that you would be aware of the type of information the Community collects, how the Community uses it, and under what circumstances, if any, would the community disclose the same.
